Terms of service
Last updated October 13, 2026
1. The agreement
These terms are an agreement between you and marmy ("marmy", "we", "us") for using the website at marmy.dev, the marmy app at app.marmy.dev and everything marmy does for you (together, the "service"). By creating an account or using the service, you agree to these terms and to our privacy policy.
marmy is for businesses. You must be at least 18 to use it. If you use it for a company or other organization, you agree to these terms on its behalf and confirm you have the authority to do so, and "you" means that organization.
2. The service
marmy is a growth agent. It studies your product and the data you connect, finds ways to bring you more users, and does the work: for example, improving your site for search, drafting and publishing content, running outreach and opening pull requests on your code.
marmy is in early access. Features may change, be limited, or be removed as we build, and some may be labeled as previews. We will give you reasonable notice before removing something you rely on when we can.
3. Your account
- Give us accurate information and keep it up to date.
- Keep your sign-in details secure, and tell us right away at legal@marmy.dev if you think someone has accessed your account without permission.
- You are responsible for what happens in your account and workspaces, including the actions of people you invite.
4. marmy acts on your behalf
When you connect a service and ask marmy to work, you authorize marmy to act for you within the access you grant, for example to read your analytics, publish content, send messages or open pull requests. marmy asks for your approval before taking actions that change things outside marmy, unless you turn on settings that let it act without asking.
Anything marmy does with your approval or under settings you enable is done on your behalf, and you are responsible for it as if you had done it yourself. Review what marmy proposes, especially code changes, before you approve or merge them.
5. Connected services
marmy works with services you connect, such as Google and GitHub. Your use of them is governed by their own terms, and you must have the right to connect the accounts you link. We aren't responsible for those services, their availability or changes they make that affect marmy. You can disconnect a service at any time in marmy or in that service's settings.
6. Acceptable use
You agree not to use marmy, or let anyone use it, to:
- Send spam or messages that break anti-spam and privacy laws, such as CAN-SPAM, CASL and the GDPR, or contact people without a lawful basis to do so.
- Break the rules of the platforms marmy publishes to, including rules on automation, disclosure and authentic behavior.
- Publish content that is deceptive, defamatory, hateful, harassing or unlawful, including fake reviews, fake endorsements or impersonation.
- Infringe anyone's intellectual property, privacy or other rights.
- Interfere with or overload the service, get around its limits or security, or access it by automated means other than what we provide.
- Reverse engineer the service, except where the law allows it, or use it to build a competing product.
We may remove content or pause actions that we reasonably believe break these rules.
7. Your content and outputs
You keep all rights to what you put into marmy and the data from services you connect ("your content"). You give us permission to host, copy, process and use your content only to run, secure and improve the service for you, and as described in the privacy policy.
As between you and marmy, you own what marmy creates for you, such as copy, content and code ("outputs"), and you may use them for any lawful purpose. Outputs come from automated systems: they may be inaccurate, and similar outputs may be created for others. You are responsible for reviewing outputs before you use or publish them.
If you send us feedback or ideas, we may use them without any obligation to you.
8. Our rights
marmy, including its software, design, brand and the models and methods behind it, belongs to us and our licensors. These terms give you the right to use the service as described here, and no other rights.
9. Fees
Parts of marmy may be free during early access. If you choose a paid plan, you agree to pay the fees and taxes shown when you subscribe, and they renew until you cancel. We will tell you before we start charging for something you use for free, and before we change your price. Except where the law requires or your plan says otherwise, fees are not refundable.
10. Suspension and termination
You can stop using marmy and close your account at any time by emailing legal@marmy.dev.
We may suspend or end your access if you break these terms, if your use creates risk or legal exposure for us or others, or if we stop offering the service. Where reasonable we will give you notice first and a chance to export your data. Sections that by their nature should survive, such as ownership, disclaimers, limits on liability and indemnity, survive termination.
11. Disclaimers
The service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement.
Growth depends on many things outside our control, including search engines, AI answer engines, social platforms and the people you reach. We don't guarantee any result, such as rankings, traffic, users or revenue, and figures shown on our website are examples, not promises.
12. Limitation of liability
To the fullest extent the law allows, marmy will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to the service or these terms. Our total liability for all claims is limited to the greater of the amount you paid us in the 12 months before the claim arose and $100. Some places don't allow these limits, so they may not fully apply to you.
13. Indemnity
You will defend and indemnify marmy against claims, losses and costs (including reasonable legal fees) brought by third parties that arise from your content, the actions marmy takes on your behalf with your approval or under settings you enable, or your breach of these terms or the law.
14. Governing law and disputes
These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws rules. Any dispute arising from these terms or the service will be resolved exclusively in the state or federal courts located in Delaware, and you and marmy consent to their jurisdiction. Before filing a claim, please email legal@marmy.dev so we can try to resolve it informally.
15. Changes to these terms
We may update these terms as marmy changes. We will post the new version here with a new date, and if the changes are significant we will tell you by email or in the app at least 14 days before they take effect. If you keep using marmy after that, you accept the new terms.
16. General
These terms and the privacy policy are the whole agreement between you and marmy about the service. If part of them can't be enforced, the rest still applies. If we don't enforce a right, we haven't waived it. You may not transfer these terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets. Neither of us is liable for delays caused by events beyond reasonable control.
17. Contact
